7. Account terms

7.1 These account terms add to our Terms and conditions of sale (OMN-LEG-001), which apply to every order on the account. If they conflict, these account terms apply.

7.2 Omnitronix decides whether to open an account and sets the credit limit. We may change the limit, put the account on hold, or close it, by written notice, for example if payments are late.

7.3 Each invoice is payable in full within 30 days of the invoice date, into the bank account in OMN-LEG-001 clause 5.4. Our banking details do not change by email. A payment into any other account is not a payment to us.

7.4 We charge no fee for the account. Overdue amounts carry interest at the rate published under the Prescribed Rate of Interest Act 55 of 1975, from the due date until paid.

7.5 Goods remain the property of Omnitronix until they are paid for in full (OMN-LEG-001 clause 7).

7.6 If we have to collect an overdue amount, the applicant pays our collection costs, including legal costs on the scale as between attorney and own client and collection commission, as far as the law allows.

7.7 The applicant consents to the jurisdiction of the Magistrates' Court for any claim under this account, even if the amount exceeds its ordinary limit (Magistrates' Courts Act 32 of 1944 s45). A certificate signed by a director of Omnitronix showing the amount owing is proof of that amount unless the applicant proves otherwise.

7.8 The applicant chooses the physical address in part 2 as its address for legal process and notices, and tells us in writing within 7 days if it changes.

7.9 The applicant tells us in writing within 7 days of any change of ownership, directors, name, address or bank account. A change of bank account is confirmed by us by phone before we rely on it.

7.10 Statements and invoices are sent to the accounts email in part 3. If the applicant does not query a statement within 14 days, it is taken as correct unless the applicant later proves an error.

8. Consent and declarations

8.1 The applicant consents to Omnitronix processing the information in this application, checking it with the references given, and obtaining a credit report from a registered credit bureau, to decide this application and manage the account. The Privacy notice (OMN-LEG-005) explains how we use and keep this information.

8.2 The signatory confirms that the information in this application is true and complete, that the applicant has read the Terms and conditions of sale (OMN-LEG-001) and these account terms, and that the signatory is authorised to sign for the applicant.
