1. About these terms

1.1 These terms apply to anyone who uses omnitronix.co.za or omnipart.co.za ("the websites"), owned and run by Omnitronix (Pty) Ltd. By using the websites you agree to them.

1.2 Orders placed on the websites are also governed by our Terms and conditions of sale (OMN-LEG-001), Delivery and shipping policy (OMN-LEG-002), Returns, refunds and exchanges policy (OMN-LEG-003), Warranty and product support policy (OMN-LEG-004) and Privacy notice (OMN-LEG-005). At checkout you confirm that you accept them before you place the order.

2.1 The Electronic Communications and Transactions Act 25 of 2002 (ECTA) s43(1) requires us to give you this information:

3. Using the websites

3.1 You may use the websites to find products, request quotes and place orders. You must not misuse them, for example by trying to get access without permission, sending harmful code, scraping the catalogue with automated tools, or placing false orders.

3.2 If you open an account, keep your login details private. You are responsible for orders placed through your account unless you tell us that someone else has used it without permission.

3.3 We may suspend an account or refuse an order where we reasonably believe the websites are being misused.

4. Product information and prices

4.1 We take care that product descriptions, part numbers, pictures, fitment information and prices are correct. Pictures may show a similar product, and manufacturers can change specifications without notice. Check the part number before you order.

4.2 Prices are in rand and do not include delivery, which is shown before you pay. A clearly wrong price is dealt with under OMN-LEG-001 clause 4.4.

4.3 Before you pay, the checkout shows the full order, the delivery charge and the total, and lets you correct mistakes or cancel (ECTA s43(2)).

5. Payment security

5.1 Card payments are processed by our payment provider over a secure connection. We do not see or store your full card number (ECTA s43(5)).

5.2 Our banking details do not change by email. See OMN-LEG-001 clause 5.

6. Intellectual property and links

6.1 The content of the websites, including text, layout, our logo and photographs we took, belongs to Omnitronix or is used with permission. Manufacturer names and logos, such as VDO and Veratron, belong to their owners. You may print or save pages for your own use, but you may not copy the content for any other purpose without our written permission.

6.2 Links to other websites, such as courier tracking pages and manufacturer sites, are given for convenience. We are not responsible for their content.

7. Liability

7.1 The websites are provided as they are. We try to keep them available and free of errors, but we do not promise that they will always be available, error-free or free of harmful code.

7.2 Except for liability that the law does not allow us to exclude, including under the Consumer Protection Act 68 of 2008, we are not liable for loss arising from your use of the websites or from their being unavailable. Liability for goods you buy is set out in OMN-LEG-001 clause 10.

8. Privacy, changes and law

8.1 Our Privacy notice (OMN-LEG-005) explains how we use personal information collected through the websites, and our Cookie and analytics notice (OMN-LEG-009) explains the cookies and the analytics banner.

8.2 We may change these terms by publishing a new revision on the websites. South African law governs these terms.
